Users

Access and/or use of the Zendal website attributes the status of USER, meaning acceptance, from such access and/or use, of the General Conditions of Use herein described. The previously mentioned Conditions will apply independently from the General Contract Conditions that may be of mandatory compliance. 

Use of the website

zendal.com provides access to a multitude of information, services, programmes or data (hereafter called ‘The Contents’) in Internet belonging to Zendal or to its licensors to whom the USER can have access. The USER takes responsibility for using the web portal. This responsibility extends to the register that’s necessary to accede to particular services or contents.

In that register the USER will be responsible for providing truthful and lawful information. As a consequence of registering, the USER is given a password under their responsibility, undertaking to make diligent and confidential use of this. The USER promises to use the contents and services properly ( as for example, chatlines, discussion boards and news groups) that under the name of the company website offers through its web portal as including but not limited as long is it isn’t used for (i) committing illegal or illicit activities or against good faith or public order; (ii) spread contents or publicity with a racist character, xenophobic, illegal pornography, encouragement of terrorism or attacks against human rights; (iii) cause damages in the physical and logical systems of the company that created,  the website, its suppliers or third parties, introduce and spread computer viruses in the network or any other physical and logical systems that are capable of causing damage as previously mentioned; (iv) attempt to enter and, in this case, use other users e-mails  and modify or manipulate their messages. Zendal reserves the right to remove those all comments and contributions that violate the dignity and respect of a person, that are discriminatory, xenophobic, racist, pornographic, that attack against infancy and minors, public order and security or that, in their opinion, prove to be inadecuate for publication. In any case, Zendal will not be responsible for opinions expressed by users in discussion groups, chatlines or other means of participation.

Data protection

Zendal complies with the guidelines of the General Regulation (EU) 2016/679 of Data Protection (RGPD) and other current regulations, and shall ensure the correct use and treatment of personal data of the user. To this end, it shall inform the USER of the existence and acceptance of the specific  Zendal conditions for the treatment of their data  in each case along with each formula collecting  personal data, in the services that the USER may request from zendal@zendal.com,  informing the user of the responsibility for the file created, the address of the person responsible, the possibility of making use of their rights of access, rectification, cancellation or opposition, the purpose of the treatment and any communication of data to third parties, where applicable. Likewise, Zendal is furthermore making known hereby that it complies with the Law 34/2002 of the 11 July, on Services for the Information Society and Electronic Commerce and shall  request their consent for processing their electronic mail.

Intellectual and industrial property rights

Zendal is the owner of all the intellectual  and industrial property rights corresponding to its web pages, as well as the elements contained therein ( e.g. images, sounds, audio,video,  software or texts, trademarks or logos, colour combinations, structure and design, the selection of materials used, computer programmes necessary for operation, access and use, etc.) owned by Zendal or their associates.

All Rights Reserved. Under the provisions of articles 8 and 32.1, second paragraph, of the Intellectual Property Law, reproduction, distribution and public communication issues are expressly prohibited, including their means of making available, in whole or part of the contents of this site for commercial purposes in any medium and for any technical means, without the permission of Zendal. The USER agrees to respect the intellectual and industrial copyright pertaining to Zendal. The USER may view the elements on the website and also print them out, copy them and store them on the hard disc of his/her computer or on any other physical medium as long as it is exclusively for his/her personal and private use. Consequently, making the said elements available, as well as the transformation, distribution, publication, and whatsoever other form of exploitation, including their modification, alteration or decompilation is absolutely prohibited.

Warranty and liability disclaimers

Zendal accepts no liability at all, for damages of any kind caused, including without limitation: errors or omissions in the content, lack of availability of the portal, correct visualization, or the transmission of viruses or programmes that are malicious or harmful in their content, in spite of having adopted all the necessary technological measures to avoid such occurrences.

Modifications

Zendal reserves the right to carry out, without prior warning, changes it considers appropriate, being able to change, delete or add both content and services the website offers as well as the way the contents and services are presented or located on its website.

Links

In the case that www.aportacomunicacion.es  has links or hyperlinks towards other Internet sites, Zendal shall not exert any kind of control over those sites and contents. Zendal will not assume liability of any kind for the contents of any link that belongs to an external website,nor does it give any guarantee  as to the technical availability, quality, reliability, accuracy, veracity and validity of any information contained in other websites.

Equally, the inclusion of these external links shall not imply any kind of association, merger or involvement in related organisations.

Right of exclusion

Zendal reserves the right to deny or withdraw access to its websites and/or services offered with no forewarning, on its own initiative or at its own request, or at that of a third party, to users who fail to meet the current General Conditions of Use. 

General points

Zendal shall pursue lack of compliance with current conditions as well as any undue use of websites by means of all manner of civil and penal actions that may be applicable under the Law.

Amendment and duration of these present conditions.

Zendal may, at any moment, totally or partially modify the terms and conditions stipulated herein, such modifications being duly published.

The duration of these conditions will be in effect during the time they are displayed and will be valid until they are modified by other duly published conditions.

Applicable legislation and jurisdiction.

The relationship between Zendal and the USER will be controlled by current Spanish Law, and any controversy will be submitted to  the courts and tribunals of the city of Pontevedra.

Personal data protection 

ZENDAL ensures the correct use and treatment of the user’s personal data, complying with current regulations: 

  • Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data and by which Directive 95/46/CE (General Data Protection Regulation – hereinafter, GDPR) is repealed.
  • Organic Law 3/2018, of December 5, Protection of Personal Data and guarantee of digital rights. 

Personal data processing 

Legitimation or legal basis: The legitimacy of the processing of personal data that you provide through this website or through the forms that are provided, may be based on the different causes assessed in article 6 of the GDPR. In general, personal data processing activities are carried out to comply with legal obligations, to fulfill missions carried out in the public interest or in the exercise of public powers conferred to ZENDAL, or because you have given your consent through clear affirmative action. 

Purpose and conservation: The processing of personal data will be limited to the minimum necessary to carry out the purposes for which they have been requested. The personal data provided will be kept for the time necessary to fulfill the purpose for which they were collected and to determine the possible responsibilities that may arise from said purpose and the processing of the data. The provisions of the Spanish archives and documentary heritage regulations will apply. It is up to the interested party to update their own data; ZENDAL will not be responsible for its inaccuracy if the changes that may have occurred are not communicated.

Exercise of rights: You can exercise your rights of access, rectification, deletion and portability of your data, limitation and opposition to its treatment, as well as not being subject to decisions based solely on the automated processing of your data, when appropriate, before ZENDAL HEALTH, S.A., with address at A Relva s/n – Torneiros, 36410 O Porriño (Pontevedra), Spain, or at the email address dpo@zendal.com. If you do not agree with the response given to your claim, you can file a claim with the Spanish Data Protection Agency: Calle Jorge Juan, 6. 28001 Madrid.
